Terms of Service
Effective date: [EFFECTIVE DATE] · Applies to Media Player Windows version 0.1.0 and later
Note for the publisher — delete this box before launch.
The substance below describes what the software actually does and is accurate for version 0.1.0. The legal wording is a starting point and has not been reviewed by a lawyer. Before publishing:
- Fill in every
[BRACKETED]value: legal entity name, address, jurisdiction, contact address, effective date. - Decide the redistribution position in section 3 — the application ships as readable Python source, so a clause pretending otherwise would not survive contact with a user.
- Have the result reviewed against the law of each market you sell or distribute into, including consumer-protection rules that may override the warranty and liability sections.
1. Who these terms are between
These Terms of Service (the “Terms”) are an agreement between you and [LEGAL ENTITY NAME], [REGISTERED ADDRESS] (“we”, “us”), the publisher of the Media Player Windows application (the “Software”) and of the website at mediaplayerwindows.com (the “Site”).
By installing or using the Software, or by using the Site, you agree to these Terms. If you do not agree, do not install the Software. The installer asks you to accept these Terms before it copies any files, and you can stop at that point without anything being written to your computer.
If you are installing the Software for an organisation, you confirm that you are authorised to accept these Terms on its behalf.
2. Licence to use the software
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software on computers you own or control, for your own purposes, personal or business, free of charge.
You may install it on more than one computer. You may copy the installation folder to removable media and run it in portable mode.
3. What you may not do
Unless applicable law gives you the right regardless, you may not:
- sell, rent, sublicense or redistribute the Software, or include it in another product or bundle, without our written permission;
- remove or alter any copyright, trademark or attribution notice in it;
- present a modified copy as the official version, or use our name, logo or the domain mediaplayerwindows.com in a way that suggests we endorse or supplied something we did not;
- use the Software to infringe anyone's rights, or to break any law that applies to you.
The Software is distributed as readable Python source with a bundled interpreter. You can therefore read it, and you may modify your own copy for your own use. That is a deliberate property of how it is shipped, not an oversight. The restrictions above are about redistribution and misrepresentation, not about looking at the code.
4. Your files and your content
The Software plays media that is already on your computer or that you point it at. We do not obtain any right to that material. We never receive it: it is not uploaded, transmitted or copied off your machine by the Software. See the Privacy Policy for the full picture.
Your settings, media library index, watch history, bookmarks and screenshots are stored on your own computer, in your own user profile, and remain yours.
5. What the software does to your computer
So that nothing here is a surprise, this is the complete list of changes the Software and its installer make. The installer states the same list before you accept it.
- Installs its files into your user profile at
%LOCALAPPDATA%\Programs\Media Player Windows. It never requests administrator rights and makes no machine-wide changes. - Creates a Start menu shortcut.
- Starts with Windows. On its first run it adds a shortcut to your Startup folder and then waits in the notification area instead of opening a window. You can switch this off at any time in Settings → General → Startup, or under Startup apps in Task Manager. Once you switch it off, the Software will not switch it back on, and updating it will not re-enable it.
- Optionally, and only if you tick the boxes on the last page of the installer: a desktop shortcut, and adding the Software to the Open with list for media file types. Neither is required.
- Writes settings, the library index and history to
%LOCALAPPDATA%\MediaPlayerWindows.
Uninstalling removes all of the above, including the startup entry. You are asked separately whether to delete your settings, library and history, and the answer defaults to keeping them.
6. Third-party components
The Software includes third-party components, each under its own licence. Those licences govern those components, and nothing in these Terms restricts rights they grant you.
| Component | Licence |
|---|---|
| Python 3.10 (bundled runtime) | Python Software Foundation License |
| wxPython / wxWidgets | wxWindows Library Licence |
| Pillow | MIT-CMU |
| mutagen | GNU GPL v2 or later |
| Send2Trash | BSD 3-Clause |
| python-mpv, python-vlc | Bindings only — see their own terms |
| Segoe Fluent Icons / Segoe UI | Supplied by Windows; used, not redistributed |
[PUBLISHER: confirm this list against the shipped build before launch, and note that mutagen is GPL — check that your distribution model is compatible, or replace it.]
7. Playback engines you add yourself
The Software can use the mpv or VLC libraries if you place them in its
backends folder. Those libraries are not
included in the installer and are not ours. If you add them, you do so
under their own licences and at your own risk, and we are not
responsible for them. Without them the Software uses the media decoders
already present in Windows.
8. Lawful use of media
You are responsible for having the right to play, copy or capture whatever you open with the Software, including any screenshot you save. The Software contains no facility for removing copy protection and must not be used to circumvent any technological protection measure.
9. Price and updates
The Software is currently provided free of charge. We may release new versions, and we may stop doing so. We are not obliged to provide updates, support or continued availability of any download.
The Software does not check for updates by itself and never contacts a server to look for one. If you want a newer version, you come here and get it.
10. Ownership
The Software, the Site, the name “Media Player Windows”, the logo and all related material are owned by us or our licensors and are protected by copyright and other laws. These Terms grant you a licence to use the Software; they do not transfer ownership of anything.
“Windows” is a trademark of Microsoft Corporation. We are not affiliated with, endorsed by or sponsored by Microsoft. The name describes the platform the Software runs on.
11. No warranty
The Software is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the Software will be uninterrupted or error-free, that it will play every file or format, or that it will be compatible with every configuration of hardware, driver, codec or Windows version.
Some jurisdictions do not allow the exclusion of certain warranties. In those places this section applies to the maximum extent permitted, and any rights you have as a consumer that cannot be excluded are not affected.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or in connection with the Software or the Site, even if we have been advised of the possibility.
Where liability cannot lawfully be excluded, our total liability is limited to the greater of the amount you paid us for the Software (which is currently nothing) or [AMOUNT AND CURRENCY].
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited under the law that applies to you.
13. Ending this licence
You may end this licence at any time by uninstalling the Software. It ends automatically if you materially breach these Terms. On ending, you must stop using the Software and remove it. Sections 10 to 12 continue to apply afterwards.
14. Changes to these terms
We may update these Terms. The current version is always the one on this page, with its effective date at the top. Material changes will be noted here, and continuing to use the Software after a change takes effect means you accept the updated Terms. The version you accepted at install time governs your use of that installed version until you update it.
15. Governing law
These Terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-laws rules, and the courts of [JURISDICTION] have exclusive jurisdiction — except that if you are a consumer, you keep any right to bring proceedings in, and to the protection of the mandatory law of, the country where you live.
